Legacy of the Horse Online Auction – Terms & Conditions & Bid Information

By placing a bid, you are entering into a binding contract of sale for the specific lot number you are bidding on.

Each horse offered in this auction has a reserve price set by the vendor.

Horses will not be considered “on the market” until the reserve price has been met.

Once the reserve has been reached, the highest bidder at the close of the auction will be the purchaser, and the contract of sale will be finalised.

Please ensure you have read and understood all auction terms and conditions before placing a bid.

These Terms & Conditions apply to all participants in the Legacy of the Horse Online Auction (“the Auction”). By registering and placing a bid, you agree to be bound by the following:

1. Parties Involved

• The Vendor of all horses listed in this Auction is Woodstock Paint Horses.

• Legacy of the Horse acts solely as the facilitator of the Auction, providing the online platform via the Legacy of the Horse website.

• Legacy of the Horse is not the Vendor and accepts no responsibility for the ownership, soundness, suitability, or condition of the horses offered for sale.

2. Bidding & Sale Process

• Each bid placed constitutes a binding contract of sale for the horse (lot number) should your bid be successful.

• All horses are offered with a reserve price set by the Vendor. Horses will not be deemed “on the market” until the reserve is met.

• The highest bid received at the close of the Auction, provided the reserve is met, will constitute a binding agreement between the purchaser and the Vendor (Woodstock Paint Horses).

• The Vendor reserves the right to remove or withdraw a horse from the Auction at any time, including during the Auction, without liability.

• Legacy of the Horse bears no responsibility for bids placed in error, technical issues, or disputes arising between bidders.

3. Payments

• Payment terms, including method and timeframe, are set by the Vendor.

• Successful bidders will be contacted directly to finalise payment arrangements with Woodstock Paint Horses.

• Horses remain the property of the Vendor until payment has been received in full and cleared.

4. Horse Information & Warranties

• Horses are sold as described in their listing.

• Descriptions, pedigrees, videos, and any other information provided have been supplied by the Vendor and are believed to be accurate.

• No warranty or guarantee is provided by Legacy of the Horse as to the health, soundness, temperament, or suitability of any horse.

• Buyers are encouraged to make their own enquiries prior to bidding.

5. Risk & Liability

• Risk for the horse passes to the purchaser immediately upon the fall of the virtual hammer (the close of Auction where the reserve has been met and you are the highest bidder).

• The Purchaser is responsible for all arrangements, costs, and risks associated with the transport and care of the horse following purchase.

• Legacy of the Horse accepts no liability for any injury, loss, or damage sustained by the horse or purchaser arising from participation in this Auction.

6. Disputes

• Any disputes regarding bidding, payment, or delivery are strictly between the Vendor (Woodstock Paint Horses)and the purchaser.

• Legacy of the Horse, as facilitator only, is not responsible for resolving disputes.

7. General

• By registering as a bidder, you acknowledge that you have read and agreed to these Terms & Conditions.

• Legacy of the Horse reserves the right to withdraw or extend Auction lots or timelines in the event of unforeseen circumstances.

• Collection of the horse by the winning bidder is to be arranged with the breeder Woodstock Paint Horses

• These Terms & Conditions are governed by the laws of Victoria, Australia.
